Terms of Service

§ 1. General Provisions

The Poppin' Press online store, available at poppinpress.com, is operated as unregistered business activity within the meaning of Article 5(1) of the Polish Entrepreneurs' Law Act of 6 March 2018 by Melania Rachwalska, correspondence address: ul. Szałwiowa 24, 40-750 Katowice, Poland (hereinafter: the “Seller”).

These Terms of Service set out the rules for placing orders, concluding sales agreements, payments, delivery, withdrawal from the agreement, and complaints in the Poppin' Press store.

A customer of the store may be a natural person with full legal capacity (hereinafter: the “Customer”).

All prices in the store are final (gross) prices in Polish złoty (PLN). The Seller is exempt from VAT. Delivery costs are visible before an order is placed.

Placing an order requires reading and accepting these Terms of Service.

§ 2. Products

The store sells hand-painted artificial nails (press-on nails) together with accessories.

All products are handmade. Each set may differ slightly from the photos shown in the store (shade, arrangement of the design). This is a natural characteristic of handcrafted products and does not constitute a defect.

The store offers: (a) personalised products, made to the Customer's individual order according to the design and nail sizes provided by the Customer, and (b) ready-made products, sets in standard sizes.

When ordering a personalised product, the Customer provides their nail sizes in accordance with the measuring guide available in the store. The Customer is responsible for the accuracy of the measurements provided, and the Seller makes the product according to the measurements stated in the order.

§ 3. Orders and Payments

Orders are placed via the order form at poppinpress.com. Placing an order requires acceptance of these Terms of Service and confirmation of the obligation to pay.

The sales agreement is concluded upon the Seller's order confirmation sent to the Customer's e-mail address.

Payments are processed by the payment provider Stripe. Available methods: BLIK, payment cards (Visa, Mastercard), Przelewy24, PayPal, Revolut Pay, and the Apple Pay and Google Pay wallets. The methods on offer depend on the Customer’s country, currency, and device. Checkout displays those available at the time.

Payment is made in advance. Order processing begins once the payment has been credited.

If payment is not made within 5 days of placing the order, the order is cancelled.

§ 4. Processing and Delivery

The order preparation time (making the product) is up to 3 business days from the date the payment is credited.

Delivery is carried out within Poland via InPost Paczkomat parcel lockers. The InPost delivery time (usually 1–2 business days), which is beyond the Seller's control, should be added to the preparation time.

The Seller is responsible for the product until it is delivered to the Customer. Details of the procedure in the event of a damaged parcel are set out in the Shipping Policy.

§ 5. Withdrawal and Complaints

The rules on returns (withdrawal from the agreement) and complaints, including the exclusion of the right of withdrawal for personalised products, are set out in the Refund & Complaints Policy, which forms an integral part of these Terms of Service.

§ 6. Personal Data

The rules on the processing of personal data are set out in the Privacy Policy available on the store's website.

§ 7. Out-of-Court Dispute Resolution

A Customer who is a consumer may use out-of-court means of handling complaints and pursuing claims, including the assistance of municipal or district consumer ombudsmen, regional Trade Inspection inspectorates, and consumer organisations in Poland.

§ 8. Final Provisions

In matters not regulated by these Terms of Service, Polish law applies, in particular the Civil Code and the Act on Consumer Rights.

Nothing in these Terms of Service excludes or limits consumer rights arising from mandatory provisions of law. In the event of any conflict, those provisions prevail.

The Seller may amend these Terms of Service for important reasons. Orders placed before an amendment are governed by the Terms of Service in force on the date the order was placed.

These Terms of Service are made available free of charge on the store's website in a manner that allows them to be downloaded, saved, and printed.
